Anyone who drives a car is part of a tightly regulated system. Topic 3 explains the three pillars - Road Traffic Regulations (StVO), Driving License Regulations (FeV) and Road Traffic Licensing Regulations (StVZO) - and shows what points, probationary period and catalog of fines mean for you.

Rule 1

Three sets of laws regulate everything

The StVO regulates behavior in road traffic (speed, right of way, behavior). The FeV regulates who is allowed to drive (driving license, classes, probationary period). The StVZO regulates what is allowed to drive (registration, technical requirements).

Rule 2

Probationary period lasts 2 years

It begins when you receive your driving license. A-violations (e.g. running a red light, disregarding the right of way) trigger an extension of the probationary period to 4 years, an advanced seminar and a written warning. Two A violations: Revocation of driving license possible.

Rule 3

Points system: from 8 points away

1 point = medium violation (e.g. speed, cell phone). 2 points = administrative offense with driving ban. 3 points = felony. For 4-5 points: written warning. For 6-7 points: written warning + advanced seminar. With 8 points: revocation of driving license.

Rule 4

Obligatory to carry with you on every journey

Always have with you in the car: driver's license, vehicle registration certificate (registration certificate part I), possibly proof of insurance (double card) for rental cars. TÜV sticker must be visible on the license plate.

Rule 5

Accident duties are sacred

Stop, secure yourself (hazard lights, warning vest, warning triangle), provide first aid, if necessary call 112/110, exchange personal details. Hit-and-run (§ 142 StGB) is a criminal offense even if there is purely property damage - a fine or up to 3 years in prison, plus the revocation of your driving license.

What goes wrong in the theory test

Error 1

Confuse StVO and StVZO

Classics in the exam. Mnemonic: StVO = behavior (order), StVZO = approval (registration order).

Error 2

Assign 'probation violation A or B' incorrectly

A = serious violation (right of way, speed > 21 km/h, red light, cell phone). B = less severe (e.g. unadapted speed without danger). Only A violations extend the probation period the first time.

Error 3

Underestimate small parking bumps

Any damage to property - even a scratch on a parked car - means you have to wait or report it to the police. A note on the window is NOT sufficient to fulfill the obligation to wait.

Error 4

Not knowing the points system thresholds

Many students believe that after 1 point the rag is gone. In fact: only from 8 points. Before: admonition (4-5), warning + advanced seminar (6-7).

You cause an accident with property damage. What do you have to do?

AnswerStop, secure the scene of the accident, get first aid if necessary, wait a reasonable time or call the police. Leaving personal information is not enough.

Anyone who simply drives away - even if there is damage to property - is committing a hit-and-run according to Section 142 of the Criminal Code.

Question 2

How long does the probation period last?

Answer2 years, starting with the issuing of the driving license. In the event of an A violation, it is extended to 4 years.

At BF17, the probationary period starts from your 17th birthday - not just your 18th.
